Ne Ne part 2, “[Fantasia’s] North Carolina home has been seized - and it’s going up for auction next week.” The notice clearly has marked a January 12, 2009 date on it, not December 12.
Second, MTO is also incorrect in calling it a foreclosure. The document depicted is not a foreclosure notice, but an Execution Sale.
A foreclosure sale is different than an execution sale. One is a judicial enforcement, the other a mortgage enforcement. A foreclosure satisfies a mortgage issue while an execution satisfy a judicial order. An execution sale is a legal process typically used in which a creditor plaintiff sales a debtor defendant’s property to satisfy an underlying judicial decision for damages.
Typically, an execution sale can be stopped if the debtor defendant satisfies the debt prior to sale. You decide.
